Landfills are a critical foundation of America’s infrastructure but are also coming under more scrutiny from regulators, activists and opportunistic plaintiffs’ lawyers. Litigation risks include allegations regarding odors and air emissions, citizen suits regarding water discharges, state and federal enforcement, permit challenges and PFAS. Concerns over methane emissions and organics diversion are also receiving significant government and public attention. In this session, three lawyers with decades of solid waste and landfill experience will survey these issues and provide the latest developments and trends. The panel will also discuss proactive measures to reduce and manage litigation risks.
